The Brexit day is steadily approaching. The UK will leave EU membership on 29 March 2019 and the transition period will commence.
The terms of our departure remain uncertain. Even if a last-minute deal is agreed, it is anyone’s guess what the new relationship with the EU will be. Are we staying in the custom’s union? Falling back on the WTO’s term of trade? Is it going to be a Canada-style plus deal?
With all this uncertainty, it cannot at all be ruled out that the supply chain for import from the EU will be disrupted. Can you warrant to your customers that a car ordered and arriving from Germany will be delivered on time? Can you be confident that parts and spares will remain readily available?
It will be prudent to include into your terms of business a clause disclaiming liability in case a customer’s order is delayed or becomes impossible to deliver due to the Brexit impact.
