As discussed in our court claims article it is cheaper for a money claim to be issued on line through the Money Claim On Line system than it is to complete a paper N1 form to send in by post.
As an example, if a customer issues a claim against you for £3500, it will cost them £185 to issue on line and £205 by post.
However, that is not the end of the story as further down the line there is another fee to be paid by the customer if the case goes all the way to a hearing. For a case of £3500 in value, the fee is £335.
Now a lot of customers don’t mind taking a punt with the initial £185 initial fee but are not so keen (or able) to fork out the subsequent £335 hearing fee on top and so this is worth bearing in mind when negotiating with customers either when they are threatening to issue a claim or if they have already issued and you reach the mediation stage.
It may just help encourage them to settle on a reasonable figure with which you are happy.

What can I do?
Review your organisations priorities and ask ‘can we afford a breach?’. What do I do during an incident? Who do I involve? When do I involve the ICO?
If you’re unable to answers these questions, you need help from the experts.
