For many years now, the UK has been subject to EU law about all manner of things including the notorious bendy bananas. How will ‘Brexit’ affect you and your business when it comes to consumer issues.

In terms of consumer law, the effect on the UK was relatively minimal as the UK was pretty much ahead of Europe anyway. For example, some consumers will quote EU Directive 1999/44/EC which gives consumers across Europe a 2 year guarantee on goods. This is oft quoted in the mistaken belief that it is a golden ticket to get a refund on something after less than 2 years use. However, UK law had already given consumers up to 6 years to raise an issue on defective goods and so for the UK, this particular piece of EU law really had no effect. In other countries it did actually enhance consumers rights and thus was passed to set a minimum precedent across all EU member countries.

Going forward, the UK have already decided that a review of each and every individual EU law will be too onerous. As a result, the Government will bring in an Act which is currently being discussed as The Great Repeal Bill. This will repeal (cancel) the European Communities Act 1972 (the law which gives authority to EU law in the UK) and will convert all existing EU law to UK law and then allow the Government to amend those converted laws as it goes along.

In short, post Brexit it will be business as usual in terms of consumer law and so dealers will just need to make sure they have a good understanding of all the current relevant laws such the Consumer Rights Act 2015, the Consumer Contracts Regulations 2013, the Alternative Dispute Resolution Regulations 2015 and the Consumer Protection from Unfair Trading Regulations.
