Again, a client has won a claim against Carlyle Finance who were seeking to reclaim commission by way of ‘claw back’. 

Admittedly the client had an easy ride in that Carlyle Finance had failed to pay the hearing fee and therefore the case was immediately dismissed. 

However, the failure to pay the fee cannot be ignored.  Motor Dealers are advised to contact the relevant Court just before the hearing to establish whether such fees are paid in future case. It will save a wasted journey.
