Back in March 2023, a change in the law meant we had to rethink how we supported our motor trade community with their court cases. We could no longer offer background guidance once proceedings started. It was a clear-cut choice: fully represent our members in court or step away completely. We could have chosen to walk away, but that would have left dealers and garages without truly affordable expert assistance.
Instead, we found a way to continue offering support without charging high street solicitor-level hourly rates. That solution was the creation of Lawgistics Litigation for the Motor Trade, a Community Interest Company.
Those who have followed our journey may remember that another motor trade firm tried to stop us from launching this service. They threatened reports to the Advertising Standards Authority (ASA), the police, and the Solicitors Regulation Authority (SRA). Neither the ASA nor the police took any interest, and following a thorough investigation, the SRA completely cleared us of any wrongdoing. We still feel second-hand embarrassment at the poor conduct and legal misunderstanding shown by that firm. It was frankly shameful.
Two years on, we’ve dealt with over 1,000 court cases for our members. These have ranged from Small Claims of £500 to Fast and Intermediate Track cases worth up to £100,000. One of our biggest wins involved successfully defending a member against a known abuser of the Distance Sales regime, putting a stop to his tactics. We’ve also helped many members deal with the aftermath of the widely reported Steve Mann Caravan alleged fraud. If the issue affects the motor trade, big or small, we’ve been involved.
Our court wins have collectively saved our dealers over £2.6 million in claims.
During this time, we’ve also raised more than £8,500 for BEN, the automotive industry charity, reflecting our continued commitment to giving back to the community we serve. You can read more or donate here.
