As we live in a digital age, there is the assumption that we don’t need paper anymore. Whilst most correspondence is now sent electronically, there is still a piece of paper at the heart of it.

Most county court judges want to read pertinent case information from a physical format, i.e. a piece of paper. Therefore, paperwork is vitally significant when we are dealing with court cases. It is important that our members complete all relevant paperwork with due care and attention, just in case we need to present it to a judge!

A recent court case of one of our members went to a preliminary hearing and the Claimant was relying on an expert’s assessment of the vehicle. We had already seen this piece of paper and were fairly confident it was not the most robust vehicle assessment we had seen. However, we did not expect the district judge to read it and then throw it in the bin!! The paperwork was a badly written assessment of a vehicle, and therefore, the district judge saw straight through it, deeming it to not be as independent as was being suggested. The judge instructed both parties to agree on an independent expert to complete the vehicle assessment.

The Claimant had been relying on their scrap of paper and the district judge’s reaction scared them sufficiently enough, so they did not comply with the instructions and failed to show up at the final hearing. A great result for our member!

The example above worked in our member’s favour. However, we see on a daily basis some very average paperwork from our members, and sometimes, no paperwork at all to assist with their court cases.
