In a recent European Court of Justice ruling it was held holiday entitlement does accrue while an employee is on sick leave and they must be allowed to carry it over the next leave year if they cannot take it in the current year.
Employees who are on long term sick leave may request to take paid holiday if their sick pay has dried up. The law previously decided that this is not allowed, the employee can’t take holiday while off sick, the employee is either off sick or on holiday.
