Insurer and warranty do battle - Templeton Insurance Ltd v Motor Care Warranties Ltd 2010

A dispute arose between the sellers of mechanical breakdown insurance, Templeton Insurance Ltd and the UK agents Motorcare Warranties Ltd. 

The trading arrangement broke down when warranty breakdown claims began to exceed premiums.

Furthermore there were allegations Motorcare had wrongly authorised policies for higher risk vehicles such as taxis, had not paid over the premiums at the correct split and Templeton considered Motorcare knew the loss ratios were higher but failed to tell Templeton thereby misrepresenting the potential for likely insurance claims.
