Sale or Return

Sometimes, you may be in possession of a vehicle which is to be sold on a sale or return basis. For the ordinary consumer, this can be confusing as they may be under the impression that they are purchasing the vehicle from the trader. Therefore they will be coming back to you should anything arise.

You as the trader, whether the vehicle is being sold on behalf of a consumer or another trader will be jointly liable for any mis-description with the vehicle.

It is therefore essential a well written sale or return agreement is in place between yourself and the seller of the vehicle. You need to ensure you are indemnified by the seller, should anything arise with the vehicle.
