In a recent case (Parsons v Butterworth Estates EAT 28.04.09) it was held that where someone raised a formal grievance for some but not all complaints then a constructive dismissal claim could proceed providing the complaints are substantial enough to support a constructive dismissal claim.
A previous case (Cyprus Airways v Lambrou) had given an alternative view that such cases should be struck out
