Not Age Discrimination if requirement for qualification

In the case of Chief Constable of West Yorkshire Police and others v Homer (2008) a 61 year old employee was rejected for the top salary grade because he didnít have a law degree. 

The employee would be unable to get a law degree before retirement. On appeal it was held it was not discriminatory since any disadvantage was due to age and not age discrimination.
