It was announced last week that changes would be being made to the Equality Act 2010, regarding third party harassment. The Reform proposes to remove these provisions (Section 40(2)-(4)) altogether.

As such, the employer will no longer be liable when an employee is harassed on more than two occasions by a third party and they have failed to prevent further harassment occurring. The Reform aims to redress the balance between the protection of employees and allowing employers to run their business effectively.  

It is not yet clear when the reforms will come into place.
