In a recent case (Cavendish Munro v Geduld), it was questioned when a ‘protected disclosure’ is made as opposed to merely an allegation.

A protected disclosure must involve the disclosure of facts, eg ‘he failed to record the accident in the accident book’ as opposed to saying ‘the employer is failing to comply with Health and Safety legislation’.
